Wonder if they'll roll out misleading labels when they start putting out Yellowstone. The only explanation for the Nicholson labels, I'll presume, is they can get away with based on its tiny market presence.

I think they have some leeway in using old labels for a bit. But not 15+ years of leeway, and of course the combination of 16 and Luxco.com is a big red flag.

Class action lawsuit anyone?

I'd settle for a bottle of actual S-W juice, no monetary damages necessary. :grin:

I just stumbled upon this one, and bought a bottle based on the DSP-KY-16 label alone. Obviously I'm bummed that it isn't actually S-W juice, but mainly I'm just curious how Luxco is getting away with this. How can they be legally using up old labels when, at least according to this thread, Luxco never owned the brand when it was S-W?

The label clearly states both DSP-KY-16 and Luxco.com - was that website even around when DN was still being made at S-W?

Important question, is it any good? There's actually a local store that has this so I'm interested.

Based on the fact that Luxco is not following the labeling laws, I doubt it is actually BiB. I picked up a bottle to OF BiB and DN BiB in the spring and the color of DN was much lighter. A shade darker than Rebel Yell. This leads me to believe DN is pretty much higher proof Rebel Yell.

Also, since it's Christmas break and I have more time on my hands than usual, I took a few minutes to submit the following letter to Luxco's website:

Hello,

I recently purchased one of your products - David Nicholson Bottled-in-Bond Bourbon - and was wondering if you could clarify a confusing detail regarding its labeling.

Specifically, the back label of the bottle states that the whiskey was distilled at DSP-KY-16, which is the government code for the Stitzel-Weller distillery. This distillery has been closed since 1993, and has a storied reputation among bourbon enthusiasts, so I was extremely excited to find what purported to be a vintage bottle from such a famed and historic source.

Some information I've found on the internet since arriving home with my purchase has made me question the veracity of the label, however. Specifically, there are multiple reports that David Nicholson is being made at Heaven Hill's Bernheim facility (DSP-KY-1), and that the labels have not been changed to reflect this situation - despite the fact that it has been over 20 years since any whiskey was distilled at DSP-KY-16.

If it is true that the bottle I purchased based primarily on its stated provenance is actually from a different source, I strongly feel that 1) I should be compensated, either monetarily or with a correctly labeled bottle from DSP-KY-16, for the expenditure I made as a result of your false advertising, 2) you should immediately correct your labels on all future bottlings to reflect the genuine origin of the contents (and to become compliant with federal regulations under Chapter 27.1.A.§5.36), and 3) you should make a public announcement apologizing for the misinformation so as to prevent other consumers from being misled by the mislabeled product currently on the market.

I sincerely hope that this problem was the result of an innocent oversight, and that your company will take all necessary steps to fix it immediately. The Bottled-in-Bond Act is not something that bourbon enthusiasts such as myself take lightly, though, and if I do not feel that this matter is resolved satisfactorily I will not hesitate to share my concerns with the TTB.

Yes indeed, considering as Chuck wrote, Luxco has now partnered up to 50% ownership in Limestone Branch founded in 2011 by Steve and Paul Beam. And they are going to start distilling Yellowstone from the original recipe. Steve Beam is quoted on how this partnership will "allow me to focus on making great bourbon". But you have to "Dance with the one that brought you" (or bought :grin:). Hope it works out for them but Luxco as a NDP hasn't impressed.

Who knows whether they'll bother to change the labels, but at least I'm getting my money back!

This is very disturbing, I just bought a bottle of DN 1843. I knew it couldn't be SW juice, and was unaware of the labeling issues (I normally don't check dsp numbers unless the bottle looks ancient). Anyways, I sent Luxco an email with my 2 cents, can't be too hard to make a different label.

A 3 year old post revival....

 

I finally have been able to get a hold of an Old Fitz BIB. While I enjoyed it I found it in my opinion to not be as enjoyable as DN1843. DN1843 has become my favorite cheap wheater. I also recently compared it side by side to WSR, and again found the DN1843 to be better IMHO. I know the Weller name seems to get all the love, but it seems to me DN1843 is the better of the 3 for a cheap wheater, and seems to never get talked about.

 

(As a side note Im only refering to WSR not 107 or W12 which are vastly superior)
