fishnbowljoe Posted April 4, 2010 Share Posted April 4, 2010 Judge limits red wax seal to KY bourbon companyLOUISVILLE, KY (AP) - The dripping red wax seal on a bottle of Maker's Mark bourbon is not only distinctive, it is now legal property of the Kentucky company.A federal judge issued an injunction Friday preventing a rival liquor company from using a dripping wax seal, ending a seven-year legal battle over the bottle topper.The ruling, by U.S. District Judge John G. Heyburn II, comes in a lawsuit between Maker's Mark and London-based Diageo North America and Casa Cuervo of Mexico over the Kentucky company's trademark on the wax seal.Cuervo used a dripping red wax seal on a special bottle of its Reserva tequila, which was distributed by Diageo.Heyburn's ruling barred the companies from using the seal, but did not award damages to Maker's Mark.
